WFTDA Open Photography Agreement

By requesting photography credentials to a WFTDA tournament, I understand my photographer credentials and any special access/entry to certain areas are contingent upon my adherence to the following terms and conditions. By signing this Agreement, I acknowledge that the failure to abide by the terms and conditions outlined herein may result in the revocation of my credentials and removal from, without readmittance to, the event(s) outlined above, and/or any future WFTDA-hosted event.

I understand that I have a limited, nonexclusive, and nontransferable license to take and use photographs of the Event as long as such use does not imply an endorsement or sponsorship relationship between a third-party and WFTDA, the leagues, teams, and/or event participants. The photos I take are my property. WFTDA claims no right to use those photographs without my consent. WFTDA has a right to view the photos taken at Event and may request a license agreement for the use of a photo.

TERMS and CONDITIONS
  1. Exclusivity. Photographer shall have the non-exclusive right to photograph Event and event participants.
  2. Use of Participant Image/Likeness. Event participants may prohibit Photographer from using their identifiable image or likeness for commercial purposes by submitting a request, in writing, to WFTDA. “Commercial purpose” is defined as use that is directly or indirectly for financial gain. Prior to the Event, WFTDA will provide Photographer with a list of those event participants (including name, team, jersey colors, and number) who will not allow their identifiable image or likeness to be used by Photographer, or any party other than WFTDA, for commercial purposes. Photographer is prohibited from the commercial use of the identifiable image or likeness of event participants appearing on this list. Failure to adhere to this provision will result in the immediate revocation of Photographer’s credentials and a ban on Photographer’s future participation in WFTDA=sponsored events.
  3. Real-time Game Coverage Restrictions. WFTDA has exclusive broadcast rights to all WFTDA events and works closely with its Official Broadcast vendor. Your photo credentials badge gives you the right to take still photos only. It does not give you the right to record video on any device. “Real-time” is defined as live and continuous description of the Event. The real-time transmission streaming video, digital images, text-casting, and/or real=time audio (including play-by-play and statistics) of the Event by anyone other than WFTDA or the WFTDA Official Broadcaster is prohibited. As a valid bearer of photographer credentials, you have the right to distribute photographs of the Event if they are time-delayed by at least five minutes after the event depicted in the photograph occurred.
  4. Proprietary Rights and Restrictions. You may not use, distribute, exhibit, reproduce, adapt, display, or publish any audio or visual accounts of the Event(s), other than in still photography. Nothing in this photo credentials agreement authorizes or allows you to violate any trademark, copyright, or other proprietary right of the WFTDA, the leagues, the teams, and/or the event participants.
  5. Spirit of WFTDA Values. You agree not to post Event or event participant photos that are not in the spirit of WFTDA’s values. This includes, but is not limited to, posting game images to websites that rely heavily on nudity, sexual content, violence, obscenity, and/or websites that advocate or promote unlawful behavior or any form of discrimination.
  6. Physical Placement/Restricted Access. You will make every effort to avoid obstructing the view or impacting the safety of any fan, event participant, official, or other attendee. The ability to shoot on the track is completely at the discretion of WFTDA. You acknowledge that the photo credential does not guarantee a track floor shooting position at any time. WFTDA reserves the right to designate certain photographer areas. If you are permitted to shoot from designated center track locations, you may only move from these areas at half-time and during official time-outs. If asked by security or tournament officials to vacate any area, for any reason, you must do so promptly.
  7. Assumption of Risk. You assume all risk and danger incidental to the sport of roller derby, as well as any risk or danger reasonably foreseeable while on the grounds of the venue, and you release WFTDA, its employees, members, directors, officers, sanctioned tournament and host sites, title sponsors, event participants, volunteers, assigns, and all agents thereof from any and all liabilities resulting from injuries or personal property loss occurring before, during or after actual play, or while otherwise at the Event venue or any associated WFTDA events.
  8. Use of Photographer Image/Likeness. In the event that your name or likeness is included in any broadcast, telecast, photograph, film, video, or other media taken in connection with the Event, you grant WFTDA a non-exclusive, transferable, perpetual right and royalty-free license to use (and to sub-license the use of) your name and likeness in any media worldwide, whether now known or hereafter devised.
  9. Credentials. Your photo credential badge must be worn at all times during the Event, and you will be subject to the direction and/or supervision of the WFTDA and its designated representatives. Your photo credentials badge is not transferable; you may not give or loan your photo credentials badge to another person for any reason.
  10. Code of Conduct. WFTDA may sever this Agreement at any time if Photographer fails to conform to the Tournament Code of Conduct, which will be available in the Tournament Program and posted at the event.
  11. Indemnification. You jointly and severally indemnify, defend, and hold WFTDA (and its employees, officers, directors, and representatives) harmless from and against any and all claims, actions, damages, liabilities, costs or expenses (including reasonable attorneys’ fees and costs of suit/arbitration) arising out of or in connection with any act or omission by you, including, without limitation, your breach of any term of contained herein. With respect to any claim that might give rise to your liability as an indemnitor, WFTDA will (a) have the right to fully participate in the litigation of such claim with counsel selected by you or your organization, and approved by WFTDA, at no expense to WFTDA; and (b) not be obligated, without its consent, to participate in any settlement of such claim.
